I have done the landing and came back to US on Automatic Visa Revalidation as my 797 is valid. No problem at all while entering in Canada. The officer just looked at the permnant resident confirmation paper, ask how much funds I am carrying. I told him I have less than a $1000 but I will be transfering funds if needed. I was not asked to show the proof. Next I went to canadian customs and gave them the goods to follow list. The officer processed that and welcomed me to Canada. The whole process took like 15-20 min. While coming back to US the officer did ask me why I was travelling and what I do in US and I told him I came here to become permanant resident and I am on H1B in US. They asked if I applied for LPR in US and I said yes and it is pending. The CBP officer was aggressive, asked me lots of other question but didn't create any issues while issuing the new I-94. So overall, things went fine.

Hi All,
I may get an offer from a company that is small with limited funding. They are not willing to do my H1B and want me to use EAD. I wanted to keep my H1B valid, but the company will make me pay for it. And given that I will have to apply for extension soon, I will have to pay for it again. So monetarily, its not good for me.
I believe you are thinking you will only get the H1 extended with this new company till Mar 2010 and you will have to apply again.
When you apply for H1 with this new company, you can request for an extension for 3 yrs based on your approved I-140. Just go ahead and apply for H1 using AC21 with a copy of I-140 approval notice. You will get it for 3 more years....No need to use your EAD.

i called uscis and they gave me the rns for ead and 485. but not for ap. they didn't provide any rns for my spouse as not present in the call. checked the money orders at bank...it was not cashed yet....anyone similar!:confused:
We had similar problem...my son checks were not cashed. Called USCIS and got RN.But the case is rejected...waiting for actual notice to resubmit.

I do not think anyone should doubt the hard work and sincerity of illegal immigrants - be they mexican or any other nationality. All these folks come to USA seeking a better life. It is a fact that politicians have used illegal immigration to their advantage - how it suits them at a particular point in time. SO I do respect the hard working nature and contribution of illegal immigration.
However you will have to appreciate that the government's policy of grouping legal and illegal immigrants in any legistative decision has proven to be a nightmare for the legal immigrants. You will also appreciate that issues and circumstances surrounding legal immigrants are substantially different from illegal immigrant issues. However legal immigrants have to face the brunt of retrogression and other processing delays due to:
1) A nonsensical approach of first letting illegal immigrants to work here, not giving them their rights for long years or enforcing the laws to deport them and then suddenly legalizing the illegals, without improving INS/DHS processes or infrastructure/Visa quotas.
2) Prospects of another huge influx of legalization which as we all know, the INS is not capable of processing with its existing operational capabilities.
I am hopeful that whatever law emerges in the next year or two should handle illegal and legal issues separately. As far as xenophobia towards hispanics, everybody has their own view, so you cannot unfairly generalize that Indians have this racism towards mexican illegals. Personally, I do not have a problem with people expressing their ethnic identity, but as we know everybody need not think like us and everybody is entitled to an opinion.

It is indeed sad that you continue to pontificate from a perch of indifference and ignorance.
From your knowledge of words it sounds to me that you should get a "PhD" in language or politics or something like that and apply for EB1...Why are you doing EB3???
If we were to buy this weak attempt at making a 'logical point', I would be glad to give Ron a call and have his folks look into YOUR respective EB2 applications and find out if there REALLY was "NO" qualified US worker available for that job. Want to play that game?
Look, the EB system is what it is. Instead of trying to bait others into silence by suddenly finding 'fairness in this system', only because this part of the puzzle narrowly goes to serve / protect your gains ... try to come together to fix the underlying weakness in the system.

I have one question, did you have any trouble while getting mortgage approval? Do you think in the changed scenario in US housing market, people like us will have problems in getting approval b'cos of our residency status and recently tightened regulations?
Well said eager_immi. Getting GC and getting job and earning is not the only thing in life. I have seen many many couple who are gc holders and citizens, giving up their career to bring up the kids for the first few years. This segment includes US citizens ( US Origin) too. Most the of the americans here have their spouse at home to take care of their kids first few years. It is not worth anybody's time and money to have a kid and put them in daycare from day one and go out and earn and pay half of it to daycare.
Enough of above, even my wife is CPA and we are married for 5 years now. She came to US dreaming about working in professional CPA firm. But my ignorance about GC process then cost her her career. She was depressed initially. I am an easy go guy and convinced her not to worry much about job. We planned and now we have 3+ year girl and a 3 weeks+ boy. Her mind is all set towards taking care of our kids and I am free from those job hunting depressions. Once both of our kids reaches 5+, she may again start to think about career. May be by then, by Gods grace, I hope to have my GC. I bought a house this year and we all live happily knowing all the uncertanites of H1. We knew it is risk to buy a house. But ultimately what is going to happen. Is anyone going to behead you in case you default or loose job? What the heck, file bankruptcy and go back to home country. At least the days we live here, we live in peace and enjoy. If you have this mindset, you will think clearly and will take positive decisions. Otherwise, everyday is hell in US for immigrants with the current GC process.
Getting GC and earning is not everything. It is only very very small part of life. Forget about it and live today's life with what you have. Worry about things which you can control. All other things will follow you automatically. Having kids is in your hand and you have to have this sooner or later. My application was sent on Aug 7th reached USCIS (NSC)on Aug 8th. Recieved my reciept # today from lawyer. But my wife haven't recieved the RN. Was wondering if any one are in the same boat.

Instead of working on recapture..we must work on filing for 485 even if PD's are not current.. this way.. atleast in this recession ppl can be assured of some piece of mind.
visa recapturing will not happen..am not being pessimistic..its just too much of a hassle...needs a law and all that.. too complicated.

Firstly, no one can shut down thoughts. They are inside your head. What I am saying is that match your thoughts with your actions, not just expression of thoughts. If you want to express your ideas and thoughts, do it in a way that its heard by people that matter. Your ideas and thoughts heard by other people like you is meaningless. If you can match ACTIONS to propogate your thoughts, by hauling your ass to Washington DC, spending some $$ out of pocket on travel to DC and meeting with a few of the 535 offices, then it matters. Which also means that they dont have to worry about making people angry.
So you see, ASKING for good things like FIFO and Faster namecheck is great in theory. But please understand, from a civic lession viewpoint, the 3 branches of government viewpoint and then make suggestions.
Is Immigration Voice an organization that can raise 100,000 a month each month? NO. Not right now. Right now, people are busy checking their mailboxes for EAD cards. Out of 23,000 registered members, if each contribute $5 a month (equivalent to a burger, fries and coke), it is 100,000 a month. But it wont happen.
So until that happens, feel free to express your thoughts and opinions and brilliant ideas and happy forum discussion. If that's what makes you all happy and content.

What is the phone number to call to get the status of application? My applicaiton received on July 2nd at Nebraska Center and still no receipt notice . Checks are not cashed either. Is there anyway to findout the receipt number?

We can not win this battle without attention from visual media like News Channel.
Traditionally we Indians are known to be camera shy silent listeners. But without the news and print media this issue will not catch enough attention from Washington to be debated. So, we have to come out of our shells and share emotional stories over news media. An inexpensive way of doing this without having to travel to any place would be to just switch on our webcam or camcorder and speak. We have to speak about the pains and put it into a story format. The content should highlight on the inefficiencies in the system , the discriminatory policies and loss to America because of the system. We definitely have to raise the following 2 issues
- recapture of lost visas over past years
- Per country visa limit
If we send thousands of these recordings as I-Reports to CNN over 2-3 days period, CNN will definitely do a story on our issue and that will catch public attention. We can decide to remain anonymous when sending the I-Reports too. We can probably do similar stuff with other news media. This will cost us nothing and will create enough news to drag attention.

Today, I received the approval notice in mail. However I did not get the physical cards. The notice says that I may have to do the biometrics again to get the but need not take any action at this time.
Received the "Card Production Ordered" email this evening at 6.30PM EST.
