    I understand if the companies want to protect their business. Let�s say that X works at a client place through a vendor. X�s employer has an agreement with the vendor which says that he cannot employ his employee, the vendor has an agreement with the client which says that they cannot take X through another vendor.

    My question is there a validity period for these agreements beyond which it becomes invalid. A couple of years should be ok but it is frustrating to be bonded to some employer for years because one doesn�t have freedom to move around and be with the same client.


    There is a time limit between X's employer and Vendor (they will renew the contract every year or so). But the problem is between X and his employer. As long as X is employed with his employer and usually 1 year there after (i.e. till one year) you can not work at same client performing same duties, this violates non-compete. If client agrees for vendor change, then employer cannot place you because of his agreement with vendor. If you are smart thinker and change both vendor and employer, then non-compete with employer will kick in.

    Sorry to hear about your situation. I would suggest that you talk to a good immigration lawyer about this.
    In the worst case scenario, if your wife has an EAD she can try to find a job and ask her company to sponsor an H-1B.
    I hope things take a turn for the better for you and your family.

    There is a mistake in the vb for Oct 2009 for Eb3 . Please look at the mumbai consulate it shows Eb3 -I cutoff date is 22 feb 2002.

    Cut Off Dates- Consulate General of the United States Mumbai, India (http://mumbai.usconsulate.gov/cut_off_dates.html). Can anyone verify the problem .

    Mistake seems to be at the Mumbai site. They seem to have copied E3-I dates from the China column of the original VB. Perhaps they will correct it quickly. On the optimistic note, we can hope that error is in the published VB, not at Mumbai site.

    This is the most shocking of the threads, I have ever read. I know it needs lot of courage to go through what you are going through. MAY GOD BLESS you with a long life and gives courage and wisdom to your family. Getting another opinion from a reputed hospital should be your top most priority. MUST GET SECOND OPINION. Miracles do happen. A friend of mine survived for almost 12 years after the doctors told him 6 months.

    I will keep you in my daily prayers and I AM SURE with so many hands folded in prayers for you, GOD will have to SHOWER with his choicest blessings and MAY YOU LIVE LONG.

    Contact the IO diectly with all the medical documents and I am sure they are HUMAN too and some one will definately be there for you to help.

    I second you.
    If 485 can be filed for both primasy and dependent when EB is current or FB is current
    this will really work pretty well. dependents can be on EAD/AP status in this case.

    iff = if and only if

    The I485s for both primary and dependent could be filed either if the family or the employment category is current.

    i.e. assume my PD is X. If X is current in FB category but not in EB category - both the primary and the dependent should still be able to file I485. Same happens if X is current in EB and not in FB.

    In this scenario - if the family based category is retrogressed:
    Option 1: Spouce can wait the retrogression out in AP/EAD.
    Option 2: Primary can become a citizen in 5 years and then "upgrade" the I485 to a new FB category with no retrogression.

    Without this joint filing if either category is current - it can cause nightmares for the dependent if the primary gets a GC and the dependent loses H4/L2.

    Employers can (at least they do) discriminate EAD holders. Here is an example and related link:
    Fog Creek Software - Intern in Software Development (http://www.fogcreek.com/Jobs/SummerIntern.html)

    "Permanent legal right to work in the United States. Because student visas (J1, F1, etc) are time-limited, we regret that we can't consider interns on student visas."


    They key word here is "Permanent legal right to work in the United States". EADs (485 based EAD as well as F1 based EADs) have a limit of 1 year/2 year/29 months etc. Based on this Fog Creek Software will not hire an EAD holder. Can we do some thing about this blatant violation of the law?


    As per I-9 form

    The refusal to hire an individual because the documents presented have a future expiration date may also constitute illegal discrimination.
    Any person wrongly discriminated due to EAD expiration date has the option of seeking claims for damages caused by the other party in court of law. I am not aware of any case involving such facts.

    the point here is not how long its gonna take. Its sure that they r gonna work if not immediately may be in 3-4 months. and once they see all the proofs(i do have proofs) whole company will be audited rock bottom, all the gc filing will be verified and single loophole is just enough to cause irriparable damage to the company. not only the reputation but i heard they will have a high penalty of 100's of thousands dollars. I have contacted one of the top lawfirms.for the matter of $4000 if the company chooses to do it, its their foolishness. also if they genuinely wanted to enforce non compete they wouldn't have used it as a threat agiainst payments they owe me.

    Its not that I haven't made any efforts to reconcile with my ex-employer. I have tried and still trying to get them to have a civil conversation and settle this. But the more I try, i beleive, they r thinking the more scared i am and are being arrogant by not replying to any of my emails or phone calls. My reconciling efforts are giving them wrong hints i beleive. I am definetly stressed about this,thats true, but i am not scared because of all the info i gathered, I know even they do file a suit, I will be on the winning side. though i have option to go directly to DOL or USCIS and can show all the proofs i have regarding the deductions they have made, i haven't made till today just because of the kind of relationship we had earlier and also concerned about other h1bs who r with the company right now. I dont want their GC's to be in jeopardy. but if employer doesn't make the effort from his side, and pulls the thread till it breaks, i can't help it.

    Has the issue of waiting times before being eligible to apply for citizenship been raised at all by Immigration Voice?? Currently one needs to wait for 5 years after being granted permanent status to be eligible to apply for citizenship. Now, considering the current backlog and the fact that Congress has mandated processing times to be much less than what we are experiencing, has the issue of getting credit for the lost backlog years in the citizenship process been raised? As I explained it to a friend the other day: This is becoming a retirement program - over 5 years at labor cert + another 4 at USCIS + 5 years waiting period + 3 years citizenship process = 0ver 17 years before we can cast a vote in this nation to which we contribute economically, intellectually, and socially. Not to forget that we are the ones doing things by the book and following the law on immigration.
